Terms of service

These terms are the agreement between you (the business using JobDiary) and [CONFIRM: legal entity name] ([CONFIRM: sole trader or limited company - include CRO number if incorporated]) of [CONFIRM: registered business address], which runs JobDiary ("we", "us"). By starting a trial or using JobDiary you agree to them. We have kept them short and plain.

What JobDiary is

JobDiary is job diary software for small field-service crews. It holds your round, rebuilds recurring jobs, sends quotes and invoices, takes payment through your own Stripe account, and chases late payers for you.

When you start a trial, we create your account and aim to email your logins within one working day of receiving your trial form. That is what we work to, not a guarantee. Setting your account up - your customers, your job cycles, your prices - is yours to do from there.

Done-for-you setup (optional): for a one-off fee of EUR 99, we will load your round in for you from the information you send us, such as a photo of your paper diary. It covers one initial import for one business, is done on a reasonable-efforts basis, and is arranged and billed separately after you start. It is a setup service, not part of the subscription, and does not change the monthly price. If we cannot complete an import from what you send, we will tell you and you will not be charged.

The free trial

The trial lasts 30 days. It needs no card, and nothing charges automatically. When the trial ends, your account simply pauses unless you choose to start a paid subscription. We will never move you onto a paid plan without you deciding to.

Price and payment

A JobDiary subscription is EUR 29 a month for the whole business. The whole crew is included, with no per-user fees.

Subscriptions are monthly and rolling. You can cancel at any time. We do not refund part-months, but your access runs to the end of the period you have paid for. [CONFIRM: VAT status - whether the operator is VAT registered and whether the prices shown include VAT]

Payments and Stripe

Taking payment from your customers: JobDiary connects to your own Stripe account, so the money your customers pay goes straight to you. Their card details are entered with Stripe and never pass through or get stored by JobDiary. Your use of Stripe is also covered by Stripe's own terms.

Your data is yours

Everything you put into JobDiary - your customers, jobs, quotes, invoices and payments - belongs to your business. You can export it, free, at any time. If you close your account, we delete your operational data and keep only the billing records we are required to keep for tax. How we handle personal data is set out in our privacy notice.

Using JobDiary fairly

JobDiary is for running your own business. Please do not use it to break the law, to store data you have no right to hold, to send spam, or to try to break, overload or copy the service. You are responsible for keeping your logins safe and for what your team does under your account. We can suspend an account that puts the service or other users at risk, and we will tell you why.

Availability

We work hard to keep JobDiary up and running, but we are a small operator and we do not promise a particular level of uptime at this stage. The service is provided on a reasonable-efforts basis. There will sometimes be maintenance or short outages, and we will give notice of planned work where we can. JobDiary does not replace your own records; please keep your own backups of anything critical.

Our responsibility to you

Nothing in these terms limits any liability that cannot be limited by law, for example liability for death or personal injury caused by negligence, or for fraud.

Subject to that, JobDiary is provided as it is, and our total liability to you in any 12-month period is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect or knock-on losses, or for lost profits, lost business or lost data beyond what we could reasonably have foreseen. You remain responsible for your own tax, your invoicing, and your dealings with your customers.

Changes

We may change the service and, occasionally, these terms, for example to reflect a new feature or a legal requirement. If we make a significant change to these terms, we will tell subscribers by email and give reasonable notice before it takes effect. If a price change ever comes, you will hear about it from us first, with notice and time to decide, never from your bank statement.

Ending your subscription

You can cancel at any time from your account or by emailing [CONFIRM: contact email]. Cancelling stops the next payment; your access runs to the end of the current paid period. We can end an account for a serious or repeated breach of these terms, with notice where possible.

Governing law

These terms are governed by the law of Ireland, and the courts of Ireland have jurisdiction over any dispute.
